These Linking Terms & Conditions apply to all links to Totally Cheer posted on third party web sites. You do not need prior approval to include a link to Totally Cheer. You must, however, comply with these simple Linking Terms & Conditions. By posting a link to Totally Cheer on a web site you agree to comply with these Linking Terms Conditions. If you do not agree to these Linking Terms & Conditions, do not link to Totally Cheer from your web site.

You may link to any page on Totally Cheer; however if you link to any page other than the home page, you agree as follows:

You acknowledge that Site Owner disclaims all express and implied warranties regarding Totally Cheer and its contents, including but not limited to warranties of title, non-infringement or that arise from course of dealing, and agree that in no event shall Site Owner be liable to you under any theory of liability including for any direct, indirect, incidental, special, consequential, punitive, exemplary or other damages based upon or relating to your linking to Totally Cheer.

These Linking Terms & Conditions will be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles. The venue for any dispute or claim arising out of or in connection with this Agreement shall be in Brunswick, Ohio.

Totally Cheer Logo Terms & Conditions

These Logo Terms and Conditions do not grant any permission to use a Totally Cheer Logo. You ("Licensee") may only post a Totally Cheer Logo on your web site if you have received written approval from Totally Cheer ("Site Owner") and then only in accordance with these Terms and Conditions.

Your use of the Totally Cheer Logo is limited to the express permission granted, and subject to all limitations contained in such permission. Use of the Totally Cheer Logo in a manner not contemplated by the permission requires a separate approval. If the permission is for a specified period, use must terminate at the end of that period unless further express, written permission is granted. We may revoke your permission at any time for any or no reason. If you receive notice of revocation, you must immediately remove the Totally Cheer Logo from your web site.

All uses of the Totally Cheer Logo must comply with all usage guidelines we may post on this web site from time to time, and must be accompanied by the following trademark notice: "Totally Cheer is a registered trademark. Used with permission." Licensee shall not remove or alter any trademark or service mark designation (i.e., "SM", "TM" or "r") provided as part of the Totally Cheer Logo.

The Totally Cheer Logo must appear separate and distinct from all other visual elements of your web site so as not to imply that Site Owner is the source of or endorses any of the materials on or offered on your web site. At a minimum, there must be at least 5 pixels of "white space" between the Totally Cheer Logo and other visual elements. The only exception to this is a textual description of the Totally Cheer content to which you are linking, which may accompany the Totally Cheer Logo. The Totally Cheer Logo must not appear as the most prominent branding of a web page or in any way that implies affiliation, sponsorship or endorsement.

Nothing herein grants any right, title or interest in or to a Totally Cheer Logo. Licensee's use of the Totally Cheer Logo, and all goodwill associated therewith, shall inure to the sole benefit of Site Owner.

Totally Cheer Logos are provided "as is" without any warranty of any kind, and Site Owner hereby disclaims all express and implied warranties, including but not limited to warranties of title, non-infringement or that arise from course of dealing. Licensee's use of the Totally Cheer Logos is at Licensee's sole risk, and in no event shall Site Owner be liable to you under any theory of liability including for any direct, indirect, incidental, special, consequential, punitive, exemplary or other damages based upon or relating to the use of the Totally Cheer Logos.
